LCSD's response on outsourced sports centre contractor organising fee-charging programmes

     In response to media enquiries regarding the booking arrangements for an outsourced contractor of the Leisure and Cultural Services Department (LCSD), Spotlight Enterprises Limited (Spotlight), which organises fee-charging programmes in the sports centres under its management, a spokesman for the LCSD today (August 7) reiterated that the department handled all hiring applications for facilities in sports centres in an impartial manner while the outsourced contractor must, in addition, comply with the restrictive provisions specified in the contracts. The spokesman assured that no privilege or preferential treatment has ever been given to the contractor.
 
     All hiring applications for LCSD sports centre facilities (including those submitted by the outsourced contractors) must be handled in accordance with the "Booking Procedure for Use of Fee Charging Recreation and Sports Facilities" under which the priorities and application arrangements have been clearly set out. Spotlight belongs to the category with the lowest priority (i.e. bona fide associations and corporations) and can reserve recreation and sports facilities three months in advance. If hiring applications from other organisations with the same priority as Spotlight are received for the same session, the allocation will be determined by balloting so as to ensure that applications from all eligible organisations are handled impartially.
 
     As an outsourced contractor, Spotlight must also comply with relevant requirements specified under the contract with LCSD, which only allow it to hire no more than 100 hours in a month and no more than 20 hours of which shall fall in peak periods for the facilities in the sports centres under its management. The outsourced contractor is also required to submit a detailed proposal on its programmes two months in advance for LCSD's approval to ensure that the programmes being organised are in line with the LCSD's mission of promoting sport for all. Other organisations are not bound by these contract restrictions. In other words, the outsourced contractor is additionally regulated by the contract requirements and therefore there is no question of granting privilege or preferential treatment to the contractor.
 
     Records show that Spotlight has organised programmes at venues and facilities with comparatively lower usage rates including squash courts, activity rooms and dance rooms in 10 of the 14 outsourced sports centres during the current contract period. The average usage rate of these facilities during peak and non-peak hours (including the sessions hired by Spotlight) are between 72% and 76%. On the other hand, Spotlight normally would not apply for those popular facilities with higher public demand, such as the multi-purpose arena for ball games at sports centres.
 
     Although in principle the LCSD can exercise its discretion under the contract to allow the contractor to hire the facilities to organise programmes for more than the above-mentioned hours, the department has only done so for programmes held at two sports centres. In making the decisions, the department mainly considered that no other organisation had applied for the same sessions whilst the contractor's proposed programmes would help further promote the facilities of the sports centres as well as provide diversified activities for public participation.
 
     According to the LCSD's "Booking Procedure for Recreation and Sports Facilities", all block bookings (including activities organised by the Home Affairs Bureau or the LCSD, and those subvented by the LCSD) during peak hours should not exceed half of the total available hours of the month, so as to ensure that adequate peak hour sessions will be available for public use to meet the needs of different venue users.
 
     The LCSD has all along been actively promoting "Sport for All". Apart from providing various recreation and sports facilities and programmes for use and participation by the public, the department also encourages both organisations and individual members of the public to hire LCSD's venues for organising programmes, training courses or competitions. With an aim to promoting sports, the department allows these kinds of activities, regardless of whether it is fee-charging or not, to be held in its leisure venues. Programmes organised by venue hirers (including Spotlight) are generally self-financed and participants may be charged an enrollment fee in order to cover the administrative or activity-related expenses. As to recreations and sports programmes organised by the LCSD, they are aimed to promote "Sport for All" and are highly subsidised by the Government, making it inappropriate to directly compare with the fees charged for programmes held by Spotlight.
 
     In conclusion, Spotlight has organised recreation and sports programmes in sports centres under its management in accordance with the LCSD's "Booking Procedure for Recreation and Sports Facilities" and relevant requirements and terms as specified in the contracts. No privilege or preferential treatment has ever been given to the contractor. These recreation and sports programmes also help promote the facilities of the sports centres and provide diversified activities for the public.
 
     The LCSD will continue to closely monitor the usage of the outsourced sports centres and the performance of contractors to ensure the service quality of these sports centres.

Murder and suicide in Mong Kok

     Police are investigating a murder and suicide case in Mong Kok last night (August 7) in which a 44-year-old woman and her 7-year-old daughter died.

     At about 6.31pm last night, Police received a report from a 28-year-old female domestic helper that odd smell was emitting from a unit on 83 Sycamore Street. Police officers sped to the scene and found the 44-year-old woman and her daughter lying unconscious inside the unit. A basin with burnt charcoal was found inside the unit. The woman and the girl were certified dead at scene.

     Post-mortem examinations will be conducted later to ascertain the cause of their deaths.

     Active investigation by the District Crime Squad of Mong Kok District is underway.
 

Regional flag day today

     Three charities have been issued Public Subscription Permits to hold flag sales from 7am to 12.30pm today (August 8). They are, on Hong Kong Island, Wu Oi Christian Centre; in Kowloon, the International Nature Loving Association Limited; and in the New Territories, Grateful Heart Charitable Foundation Limited, a spokesman for the Social Welfare Department (SWD) said.

     Arrangements have been made with the charities to help people distinguish between the three flag-selling activities.

     In the case of suspected fraudulent flag day activities, people should not make any donation and should immediately report the matter to the Police, the spokesman added.

     The Labour Department reminds employers that as the Very Hot Weather Warning is in force, they should assess the risk of heat stroke to their employees and adopt effective preventive measures such as providing cool drinking water, setting up temporary sunshade and providing mechanical aids to reduce physical exertion of employees. Employees should drink water regularly and be mindful of their physical condition. If early heat stroke symptoms such as headache and thirst appear, they should inform their supervisors and seek medical help immediately.

CHP reminds public on precautions against heat stroke during very hot weather

     The Centre for Health Protection (CHP) of the Department of Health (DH) today (August 8) reminded members of the public, particularly those undertaking outdoor activities, to take heed of necessary measures against heat stroke and sunburn in very hot weather.

     "The public should carry and drink plenty of water to prevent dehydration while engaging in outdoor activities," a spokesman for the CHP said.

     "Those engaged in strenuous outdoor activities should avoid beverages containing caffeine, such as coffee and tea, as well as alcohol, as they speed up water loss through the urinary system," the spokesman explained.

     "The obese, the sick, including those with heart disease or high blood pressure, the old and the young are more vulnerable to heat-related illnesses. They should pay special attention," the spokesman added.

     The public should adopt the following precautions:
 
  • Wear loose and light-coloured clothing to reduce heat absorption and facilitate sweat evaporation and heat dissipation;
  • Avoid vigorous exercise and prolonged activities like hiking or trekking as heat, sweating and exhaustion place additional demands on the physique;
  • Perform outdoor activities in the morning or late afternoon;
  • For indoor activities, open all windows, use a fan or use air-conditioning to maintain good ventilation; and
  • Reschedule work to cooler times of the day.

     If working in a hot environment is inevitable, introduce shade in the workplace where practicable, and start work slowly and pick up the pace gradually. Get into a cool area for rest at regular intervals to allow the body to recuperate.

     The public should also note the latest and the forecast Ultraviolet (UV) Index released by the Hong Kong Observatory (HKO). When the UV Index remains high (6 or above):
 
  • Minimise direct exposure of the skin and the eyes to sunlight;
  • Wear loose long-sleeved clothing made of close-woven fabrics;
  • Wear a wide brim hat or use an umbrella;
  • Seek a shaded area or put on UV-blocking sunglasses;
  • Apply a broad-spectrum sunscreen lotion with a sun protection factor (SPF) of 15 or above. Apply liberally and reapply after swimming or sweating; and
  • While using DEET-containing insect repellents for personal protection against mosquito-borne diseases, apply sunscreen first, then insect repellent.

     If symptoms develop, such as dizziness, headache, nausea, shortness of breath or confusion, rest and seek help immediately, and seek medical advice as soon as possible.

HKSAR Government delegates to attend hearing of UN Committee on the Elimination of Racial Discrimination

     A delegation representing the Hong Kong Special Administrative Region (HKSAR) Government will attend a hearing of the United Nations Committee on the Elimination of Racial Discrimination in Geneva, Switzerland, on August 10 and 13 (Geneva time).

     A government spokesman said today (August 8) that, as part of the Chinese delegation, the HKSAR delegation will introduce to the Committee the part of China's 14th to 17th reports under the International Convention on the Elimination of All Forms of Racial Discrimination (ICERD) which is related to the HKSAR, and answer the Committee's questions on the implementation of the ICERD in Hong Kong.
    
     "This is the third time the Committee has examined a report submitted by the HKSAR under the ICERD since 1997. The previous round of hearings was held in August 2009," the spokesman added.

     The delegation will be led by the Under Secretary for Constitutional and Mainland Affairs, Mr Andy Chan, and the members of the delegation will include officials from the Constitutional and Mainland Affairs Bureau, the Security Bureau, the Education Bureau, the Labour Department and the Department of Justice.

Youth Development Commission to visit Hong Kong interns in Shenzhen

     The Chief Secretary for Administration and Chairman of the Youth Development Commission (YDC), Mr Matthew Cheung Kin-chung; the Secretary for Home Affairs, Mr Lau Kong-wah; and members of the YDC will depart for Shenzhen in the morning on August 10 to visit Hong Kong interns there. 

     Mr Cheung and Mr Lau will respectively lead members of the YDC to visit enterprises and organisations providing internship places for Hong Kong youths under the internship programme organised by the Y.Elites Association in Qianhai and that organised by the Hong Kong Youths Unified Association and the Young Professionals Alliance in Nanshan. They will meet with the management and exchange views with Hong Kong interns to know more about their experience.

     Mr Cheung, Mr Lau and all members of the YDC will return to Hong Kong in the afternoon on the same day.

The following is issued on behalf of the Hong Kong Monetary Authority:

     The Hong Kong Monetary Authority (HKMA) announces that a tender of 2-year Exchange Fund Notes will be held on August 17, 2018 (Friday) for settlement on August 20, 2018 (Monday), as set out in the tentative issuance schedule announced on May 15, 2018. This is to roll over an issue of 2-year Exchange Fund Notes maturing on the same day. 
 
     A total of HK$1,200 million 2-year Notes will be on offer, of which HK$5 million will be made available for offer to members of the public who wish to submit non-competitive tender bids through Hong Kong Securities Clearing Company Limited (HKSCC). If the Notes reserved for non-competitive tender are under-subscribed, the non-subscribed amount will be added to the portion of notes for competitive tender (initially set at HK$1,195 million). The Notes will mature on August 20, 2020 and will carry interest at the rate of 1.78 per cent per annum payable semi-annually in arrears.
 
     Members of the public who wish to submit non-competitive tender applications for Notes that are open to HKSCC may do so through Stock Exchange Participants/Brokers, or for those who hold Investor Accounts of the Central Clearing and Settlement System (CCASS) at the HKSCC, directly through HKSCC, for submission to the HKMA for processing. Competitive tender applications for the Notes must be submitted through any of the Eligible Market Makers on the current published list, which can be obtained from the HKMA at 55/F, Two International Finance Centre, 8 Finance Street, Central, Hong Kong (telephone: 2878 1465), or from the HKMA's website at www.hkma.gov.hk; Each tender must be for an amount of HK$50,000 or integral multiples thereof for both competitive and non-competitive tender.

Hong Kong Customs seizes suspected methamphetamine (with photo)

     Hong Kong Customs seized about 950 grams of suspected methamphetamine with an estimated market value of about $520,000 at Hong Kong International Airport on July 25.

     Customs officers inspected an express parcel from Malaysia on July 25 and seized about 950g of suspected methamphetamine concealed inside the metal frames of a baby chair.

     After follow-up investigation, Customs officers yesterday (August 7) arrested a 47-year-old woman and a 48-year-old man in Tsing Yi, who are suspected to be related to the case. A set of drug-inhaling apparatus was further seized from the arrested woman's residential premises in Tsing Yi. Customs officers also seized a small quantity of suspected methamphetamine and a set of drug-inhaling apparatus in the arrested man's possession.

     Investigation is ongoing.

     Under the Dangerous Drugs Ordinance, trafficking in a dangerous drug is a serious offence. The maximum penalty upon conviction is a fine of $5 million and life imprisonment.

Five amendment regulations under Electoral Affairs Commission Ordinance to be gazetted on Friday

The following is issued on behalf of the Electoral Affairs Commission:
 
     Five amendment regulations to amend the subsidiary legislation under the Electoral Affairs Commission Ordinance (Cap. 541) will be gazetted this Friday (August 10). The amendments aim to refine the requirements relating to the identity documents that electors must produce in applying for ballot papers, which have been put in place by the Electoral Affairs Commission (EAC) through another set of amendment regulations on June 19, 2017.
 
     "At present, an elector who is unable to produce the original of his or her identity document, typically a Hong Kong permanent identity card (HKID), in collecting the ballot papers may produce a document evidencing a report to a police officer of the loss or destruction of the person's identity document (commonly referred to as a 'memo of lost property'), together with the original of the person's valid passport or similar travel document showing his or her name and photograph, and a copy of his or her identity document in paper form showing his or her name, photograph and identity document number. The amendment regulations to be gazetted seek to relax the document requirement of the aforesaid alternative measures such that an elector who has lost his or her HKID will be allowed to collect a ballot paper by producing only the memo of lost property and the original of a valid passport or similar travel document showing his or her name and photograph, without presenting a copy of his or her HKID in paper form at the same time," a spokesperson for the EAC said today (August 8).
 
     "We note that the information contained in the memo of lost property, i.e. the name and HKID number of an elector, could be used to cross-check against the information that appears on the passport or similar travel document concerned, and the relevant entry in the Final Register. Furthermore, it is a criminal offence to make a false report to the police. As such, the authenticity of the information provided in the memo of lost property could thus be relied upon," the spokesperson explained.
 
     Separately, the existing electoral legislation makes reference to "identity document" as defined under the respective EAC regulations or the main Ordinances when it comes to issuance of ballot papers. To provide greater clarity in the regulations, the amendment regulations to be gazetted also seek to change the reference to "identity document" in the relevant provisions to specific references to the identity documents that could be accepted by the presiding or polling officers (as appropriate) in issuing ballot papers to electors, i.e. the HKIDs and the Certificates of Exemption issued by the Immigration Department.
 
     The five regulations to be amended are the Electoral Affairs Commission (Electoral Procedure) (Legislative Council) Regulation (Cap. 541D), the Electoral Affairs Commission (Electoral Procedure) (District Councils) Regulation (Cap. 541F), the Electoral Affairs Commission (Electoral Procedure) (Election Committee) Regulation (Cap. 541I), the Electoral Procedure (Chief Executive Election) Regulation (Cap. 541J) and the Electoral Procedure (Rural Representative Election) Regulation (Cap. 541L).

     The amendment regulations will be tabled at the Legislative Council (LegCo) on October 10, 2018 for negative vetting. Subject to the scrutiny by the LegCo, they will come into operation on December 10, 2018.

Technical issues of HKMC Annuity Plan's online registration system

The following is issued on behalf of the Hong Kong Monetary Authority:

     The spokesman of the HKMC Annuity Limited (HKMCA) announced today (August 8) that the online registration of HKMC Annuity Plan is currently out of service due to technical issues of the corporate website of the HKMCA. The technical staff of the HKMCA is carrying out emergency repairs in order to resume the service as soon as possible.  
 
     Given the above condition, the online registration of the HKMC Annuity Plan will be extended by one day till 11.59pm on August 9. The forms collection time of the agent banks will remain unchanged (until close of business today). The above arrangement will not affect the other applicants as the HKMCA expect the issuance cap is sufficient to absorb all subscription demand. The HKMCA sincerely apologises for the above situation and further announcement will be made upon the resumption of services.

     The temporary night heat shelters will resume their functions as either community centres or community halls in the daytime for hire by the local community and cannot continue to be open as heat shelters. People may choose to take refuge from the heat during the daytime in the common areas in any of the 21 designated community centres or community halls. Their opening hours are from 9am to 10pm. SCS visits Islands District (with photos)

     The Secretary for the Civil Service, Mr Joshua Law, today (August 8) visited Islands District, exchanging views with Islands District Council (IDC) members on various issues, and getting an update on the latest developments of the district's major infrastructure projects and the Tung Chung New Town Extension (TCNTE) project.

     Accompanied by the Chairman of the IDC, Mr Chow Yuk-tong, and the District Officer (Islands), Mr Anthony Li, Mr Law met with IDC members and exchanged views on issues that concern them. He also proceeded to HKIA Tower, where he was briefed by the Airport Authority Hong Kong on the three-runway system and the SkyCity project.

     During the district visit, Mr Law observed from height at Ying Tung Estate in Tung Chung the various infrastructure and development projects, including the Hong Kong-Zhuhai-Macao Bridge, a cross-boundary transport infrastructure project connecting Guangdong, Hong Kong and Macao, and the Tung Chung East reclamation works under the TCNTE project. He was also briefed on the projects' latest progress by colleagues of related departments.

     Mr Law said he was pleased to learn that the TCNTE project, a large-scale land formation project, will allow the development of housing, the economy and the community to run in parallel. The project will provide about 50 000 residential flats and about 870 000 square metres of commercial floor space, accommodating an additional population of more than 140 000 and creating about 40 000 job opportunities.

     Mr Law said, "Apart from a better grasp of public sentiments, district visits enable me to get updates on the latest developments in the community. In today's Islands District visit, I have conducted a journey on major infrastructure, which has enhanced my understanding of the efforts made by the civil service colleagues on these projects."

Report on the Currency Board Operations (April 17 – June 14)

     The Sub-Committee noted that during the review period, the Hong Kong dollar (HKD) traded within a range of 7.8427 – 7.8500 against the US dollar (USD). Since the first triggering on April 12, the weak-side Convertibility Undertaking (CU) was triggered 19 times and the Hong Kong Monetary Authority bought HK$70.4 billion under the weak-side CU. The Aggregate Balance and the Monetary Base fell correspondingly after the multiple triggering of the weak-side CU, with the Monetary Base declining to HK$1,643.77 billion at the end of the review period. The HKD firmed again towards the end of the review period, in part underpinned by seasonal demand for the HKD (e.g. corporate demand for dividend payments) and interbank demand in preparation for sizable initial public offering (IPO) activities. 
 
     The Sub-Committee noted that largely reflecting IPO-related demand, reduced interbank liquidity following triggering of the weak-side CU, expectation of US rate hikes and seasonal liquidity demand, HKD interbank interest rates picked up across the curve during the review period. 
 
     The Sub-Committee further noted that, in accordance with the Currency Board principles, all changes in the Monetary Base had been fully matched by changes in foreign reserves.
 
     The Report on Currency Board Operations for the period under review is at the Annex.
 
Monitoring of Risks and Vulnerabilities

     The Sub-Committee noted that in the US, although solid growth performance led the Federal Reserve Board (Fed) members to suggest a Dot Plot Median Forecast of four rate hikes in 2018, the Fed might need to weigh between rising inflationary pressures and downside risks to growth from trade conflicts further down the road. 
 
     The Sub-Committee noted that the US dollar strengthening and escalating trade tensions had put pressure on capital outflows from emerging market economies, and might weigh on their growth outlook.
 
     The Sub-Committee noted that in Mainland China, domestic demand showed signs of moderation but investment in high-value added manufacturing sectors remained solid. Rising trade tensions and signs of slower growth would pose challenges for Mainland authorities to calibrate policies to strike a balance between reducing financial risks and achieving stable growth.
 
     The Sub-Committee noted that in Hong Kong, economic growth accelerated in the first quarter and the growth momentum was expected to remain solid albeit at a slightly slower pace. The sanguine outlook was against the background of heightened uncertainties, particularly from the threat of trade tensions.
 
Interest Rate Sensitivity of Hong Kong Dollar Money Demand

     The Sub-Committee noted a study which examined the lower interest rate sensitivity of HKD money demand since the global financial crisis.

Managers of unlicensed guesthouses fined

     Two men were charged with contravening the Hotel and Guesthouse Accommodation Ordinance at the Kowloon City Magistrates' Courts today (August 8). A man was sentenced to two months' imprisonment, suspended for two years, and fined $12,000. The other man was fined $8,000.

     The courts heard that in July last year and February this year, officers of the Office of the Licensing Authority (OLA), the Home Affairs Department, inspected two suspected unlicensed guesthouses on Shanghai Street and Portland Street in Mong Kok. During the inspections, the OLA officers posed as lodgers and successfully rented rooms in these guesthouses on a daily basis.

     According to the OLA's records, these guesthouses did not possess licences under the Ordinance on the days of inspection. The men responsible for managing the premises were charged with contravening section 5(1) of the Ordinance.

     A department spokesman stressed that operating or managing an unlicensed guesthouse is a criminal offence and will lead to a criminal record. Upon conviction, the offender is liable to a maximum fine of $200,000 and two years' imprisonment.
            
     The spokesman appealed to anyone with information about suspected unlicensed guesthouses to report it to the OLA through the hotline (Tel: 2881 7498), by email (hadlaenq@had.gov.hk), by fax (2504 5805) using the report form downloaded from the OLA website (www.hadla.gov.hk), or through the mobile application "Hong Kong Licensed Hotels and Guesthouses".
